Foreclosure Postings
Overview
The Clerk’s Office does not conduct or participate in the Foreclosure Sale and is not involved in the foreclosure process other than maintaining public records which are filed by interested parties. Notices of Sale are generally posted by the appointed Trustee or Substitute Trustee who conduct the Foreclosure Sale for that property. All questions or inquiries regarding the status of a property to be sold at foreclosure should be directed to the current Trustee and/or Attorney listed on the Notice of Sale.

Fees and Requirements
The fee for posting a Notice of Sale is $3.00.
Foreclosure Sale Notices must be posted at least 21 days prior to the sale. The location for posting Notices of Sale is the bulletin board inside the West door of the Erath County Courthouse.
When and Where
The public auction is held between 10:00 AM and 4:00 PM on the first Tuesday of every month, with the exception that if the first Tuesday occurs on January 1 or July 4, then the sale will be held on the first Wednesday of the month.
The location for foreclosure sale is outside the South door of the Erath County Courthouse (exterior steps to the main floor facing College Street).
